Assumption of Risk/Release and Waiver of Liability
This form must be signed and submitted before an individual can participate in classes.
I, {name}, certify that I will be participating in martial arts classes, including Tai Chi, Hsing-I, Ba Gua, Standing Meditation, Push Hands, Form Applications, and Weapons Forms.
I recognize and understand the following:
That martial arts is a physical activity and that there are inherent risks associated with taking these classes and practicing the techniques, including the risk of serious injury and, under certain circumstances, even death.
That any medical conditions, known or unknown, could be impacted by class activity, which can be strenuous, and that all conditions/medications should be discussed with a physician before beginning the class. It is my responsibility to seek such advice and act on it accordingly.
That the health benefits of a physical exercise, whether stated or implied, can vary based on the individual and that certain exercises may require the approval of a physician. Again, it is my responsibility to seek such approvals and I assume all risks if I choose to ignore or fail to obtain a physician’s consent.
That I could be injured as the result of my own negligence, the negligence of others or, through no fault of my own or others, purely because of the nature of the class; and I expressly assume these risks.
I hereby release and discharge Cheng Ming USA - VA, LLC, James H. Lee, and all participating groups and instructors from any and all liabilities that may be incurred as a result of my participation in these classes.
Cheng Ming USA - VA, LLC, James H. Lee, and all participating groups and instructors shall not be held accountable, liable for, nor do they assume or accept responsibility for injury, accidents, or loss of property which occur during the classes while the participant is on or off the premises; and I hereby waive and release any and all claims against the participating groups, instructors, and all other people and entities associated directly or indirectly with the classes from all injuries, damages, or losses.
I also hereby waive and release (give up) any and all rights that I or my heirs may have to make a claim arising from any damages, injury or death which I might sustain. I further agree to indemnify (hold harmless) all persons and entities named or described in this document from any and all claims, which I might make or might be made on my behalf by others.
By signing this release and waiver, I understand that the rights described above are being given up (waived or released). It is my intent to give up these rights and to hold harmless these persons and entities, and I do so knowingly and voluntarily.
Arbitration. All claims and disputes arising under or relating to this Agreement are to be settled by binding arbitration in the state of Virginia or another location mutually agreeable to the parties. An award of arbitration may be confirmed in a court of competent jurisdiction.
